ACCOMMODATION AGREEMENT
Accommodation Agreement
Article 1 (Scope of Application)
Accommodation contracts and related agreements to be entered into between the Hotel and guests shall be subject to the provisions of this Agreement, and any matters not stipulated herein shall be governed by laws and regulations or generally established practice.
Where the Hotel enters into a special agreement that does not conflict with laws and regulations or established practice, such special agreement shall take precedence, notwithstanding the preceding paragraph.
Article 2 (Application for Accommodation Contracts)
A guest who intends to apply for an accommodation contract with the Hotel shall notify the Hotel of the following particulars:
- Name of the guest(s)
- Date of stay and expected arrival time
- Accommodation charge
- Other particulars deemed necessary by the Hotel
Where a guest requests, during their stay, an extension of the stay beyond the date set out in item 2 of the preceding paragraph, the Hotel shall treat such request as a new application for an accommodation contract at the time the request is made.
Article 3 (Conclusion of Accommodation Contracts, etc.)
An accommodation contract shall be concluded when the Hotel accepts the application set out in the preceding article. This shall not apply, however, where the Hotel proves that it did not give its acceptance.
When an accommodation contract has been concluded pursuant to the preceding paragraph, the guest shall pay an application fee, as designated by the Hotel, up to the basic accommodation charge for the period of stay (up to three days where the stay exceeds three days), by the date designated by the Hotel.
The application fee shall first be applied to the accommodation charge ultimately payable by the guest; then, should the circumstances under Articles 6 and 18 arise, it shall be applied in the order of the cancellation charge and then the compensation; and any remainder shall be refunded at the time payment of charges is made under Article 12.
Should the guest fail to pay the application fee under the preceding paragraph by the date designated pursuant to the same paragraph, the accommodation contract shall become invalid. This shall apply only where the Hotel has notified the guest of this consequence when designating the payment date for the application fee.
Article 4 (Special Agreement Requiring No Application Fee)
Notwithstanding paragraph 2 of the preceding article, the Hotel may agree to a special arrangement not requiring payment of the application fee set out in that paragraph after the contract has been concluded.
Where the Hotel, in accepting an application for an accommodation contract, does not request payment of the application fee under paragraph 2 of the preceding article and does not designate a due date for such payment, the Hotel shall be deemed to have agreed to the special arrangement set out in the preceding paragraph.
Article 5 (Refusal to Conclude an Accommodation Contract)
The Hotel may decline to conclude an accommodation contract in any of the following cases:

- Where no guest rooms are available due to full occupancy.

Article 6 (Guest's Right to Cancel the Contract)
A guest may cancel the accommodation contract by notifying the Hotel.
Where the guest cancels all or part of the accommodation contract due to a cause attributable to the guest (excluding cases where the Hotel has designated the payment date for the application fee under Article 3, paragraph 2, and the guest cancels the contract before that payment is due), the Hotel shall charge a cancellation fee. This shall apply only where, in agreeing to the special arrangement under Article 4, paragraph 1, the Hotel has notified the guest of their obligation to pay a cancellation fee upon cancellation.
Where the Hotel does not hear from the guest and the guest does not arrive by 10:00 p.m. on the date of stay, the Hotel may treat the accommodation contract as having been cancelled by the guest.
Article 7 (Hotel's Right to Cancel the Contract)
